Terms and Conditions of Use (GTC)

Article 1: Company Identification

These General Terms and Conditions of Sale (GTC) govern the sale of products offered by the company Card ‘Em All Manini, registered in the commercial register under number CHE-425.715.318, whose registered office is located at Route de Taillepied 38 – 1095 Lutry.

By placing an order on the website www.cardemall.ch (hereinafter, the "Site"), the customer (hereinafter, the "Client") unreservedly accepts these GTC.

Article 2: Products

The products offered for sale are those listed on the Site on the day of consultation by the Client, within the limits of available stock. Descriptions, illustrations, and specifications of the products are provided for informational purposes and may be modified by Card ‘Em All Manini.

Article 3: Prices

All prices are indicated in Swiss Francs (CHF) including VAT, including the applicable VAT in Switzerland. Delivery costs and any other potential fees are specified before the order is confirmed.
Card ‘Em All Manini reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time the order is confirmed by the Client.

Article 4: Order

To place an order, the Client must follow the online purchase process on the Site. Any order confirmed by the Client implies acceptance of these GTC.
Card ‘Em All Manini reserves the right to refuse or cancel any order in case of a previous dispute with the Client, suspicion of fraud, or non-payment.

Article 5: Payment

Payment is made online by the following means:

  • Credit/debit card (Visa, MasterCard, etc.)
  • Other payment methods accepted by the Site

    The total amount of the order is debited upon its confirmation. In case of a payment problem (bank refusal, etc.), the order will be cancelled.

    Article 6: Delivery

    Products are delivered to the address indicated by the Client during the order. Card ‘Em All Manini delivers in Switzerland. Delivery times are indicated on the Site for informational purposes and may vary depending on the destination and product availability.

    Delivery costs are borne by the Client and are specified before the order is confirmed. Card ‘Em All Manini may occasionally offer free deliveries for certain orders, depending on the total amount or special promotions. This free delivery does not apply to orders containing pre-order products, due to potential separate delivery dates between items.

    Card ‘Em All Manini cannot be held responsible for delays due to delivery services or force majeure.

    Hand-delivery option: 

    The Client has the option to choose the Hand-delivery (by appointment) option when placing their order. As specified in these GTC, this hand-delivery is only available in Lutry (VD) and requires a prior appointment to be made by email.

    If the Client cannot travel to Lutry, they may request:

    • either a refund of their order
    • or postal shipment, subject to additional fees

    Article 7: Right of Withdrawal

    Due to the fluctuating market prices of the products offered on the Site, no right of withdrawal is granted after the order has been confirmed. The Client may neither cancel nor return their order for any reason whatsoever once it has been confirmed, except in the event of a defect or non-conformity of the product received, in accordance with the provisions of Article 8.

    Products must therefore be purchased with full knowledge, and the Client unreservedly accepts this non-withdrawal policy by placing an order on the Site.

    Article 8: Legal Guarantee and Claims

    The products sold benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the Swiss Code of Obligations (CO).

    • The legal guarantee is 2 years from the delivery date.
    • In case of a lack of conformity or a hidden defect, the Client may request a replacement of the product or, failing that, the cancellation of the sale.

      Claims must be sent to contact@cardemall.ch, accompanied by proof of purchase and the reasons for the claim.

      Article 9: Personal Data Protection

      Personal data collected during the order is necessary for processing and managing orders. It is processed in accordance with the Federal Data Protection Act (FADP).

      The Client has the right to access, rectify, and delete their personal data by contacting the company at the following address: contact@cardemall.ch.

      Personal data will under no circumstances be communicated to third parties, except for order processing (e.g., delivery).

      Article 10: Liability

      The liability of Card ‘Em All Manini is limited to the amount of the order. The company cannot be held responsible for indirect damages related to the purchase of products on the Site.

      Card ‘Em All Manini cannot be held responsible in cases of force majeure or unforeseeable events such as strikes, bad weather, or interruptions in logistical services.

      Article 11: Applicable Law and Competent Jurisdiction

      These GTC are subject to Swiss law. In case of a dispute relating to the interpretation or execution of these GTC, the parties will endeavor to resolve the dispute amicably. Failing agreement, the dispute will be submitted to the jurisdiction of the courts of the canton of Vaud.

      Article 12: Modifications to the GTC

      Card ‘Em All Manini reserves the right to modify these GTC at any time. The applicable GTC are those in force at the time the order is confirmed by the Client.

      Article 13: Pre-orders

      Certain products offered on the Site may be available for pre-order. In this case, an explicit mention is indicated on the product sheet, specifying the nature of the pre-order and the estimated delivery date.

      By placing a pre-order, the Client accepts this particular ordering method and understands that delivery will be delayed until the products are received by Card ‘Em All Manini. The release or delivery dates mentioned are provided for informational purposes only and may be modified by the publisher or supplier.

      If an order contains both in-stock and pre-order items, the shipment will be split. In this case, delivery fees may be charged for each partial shipment, and any free delivery offers will not apply.

      Card ‘Em All Manini undertakes to inform the Client in case of significant delay or unavailability of the product. In case of definitive unavailability or cancellation of the release, the order amount will be fully refunded to the Client according to the initial payment method.

      The pre-order conditions do not modify the policy of no right of withdrawal defined in Article 7.
